These Terms of Service (“Terms”) govern your access to and use of OtterPDF and related websites, applications, and services (collectively, the “Service”). By using the Service, you agree to these Terms.
Eligibility and accounts
You must provide accurate information and keep it up to date. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. If you believe your account has been compromised, contact us promptly.
Guest mode
If guest mode is available, you may be able to use parts of the Service without creating an account. Guest sessions can be temporary, may have feature limitations, and may be removed automatically.
Acceptable use
You agree not to misuse the Service. For example, you will not:
- Break the law: use the Service for unlawful activities or to violate others’ rights.
- Upload prohibited content: content you do not have rights to use, or content that is illegal, infringing, or harmful.
- Attack the Service: attempt to bypass security, probe vulnerabilities, or interfere with service operations.
- Abuse sharing features: distribute share or signing links to unintended recipients or harvest content via automated means.
- Automate without permission: use scraping, bots, or excessive requests that degrade performance.
Your content and permissions
You retain ownership of your documents and other content you upload (“Content”). To operate the Service, you grant us a limited, non-exclusive, worldwide license to host, store, reproduce, process, and display your Content solely for the purpose of providing, maintaining, and improving the Service (including creating previews, saving versions, and generating outputs you request such as flattened signed PDFs).
You represent and warrant that you have all rights necessary to upload and process your Content, and that doing so does not violate any law or third-party rights.
Sharing and signing links
The Service may let you create view-only share links or invite signers to access documents via unique links. Anyone with a valid link may be able to access the shared document or signing session. You are responsible for managing and distributing links securely and only to intended recipients.
Plans, billing, and refunds
Some features may require a paid plan. If you purchase a subscription, you authorize charges through the payment provider and agree that subscription fees may be billed on a recurring basis until you cancel. Taxes may apply.
Unless required by applicable law or explicitly stated at purchase, payments are non-refundable. If you believe a billing error occurred, contact us and we’ll review it.
Termination
You may stop using the Service at any time. We may suspend or terminate access to the Service if we reasonably believe you violated these Terms, pose a security risk, or if required by law. Where appropriate, we may provide notice and an opportunity to address the issue.
Third-party services
The Service may integrate with third-party services (for example, payment processors). Your use of third-party services is governed by their own terms and policies, and we are not responsible for third-party services.
Disclaimers
The Service is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or that Content will always be recoverable.
Limitation of liability
To the fullest extent permitted by law, OtterPDF and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising from or related to your use of the Service.
Indemnification
You agree to indemnify and hold harmless OtterPDF from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of your Content, your use of the Service, or your violation of these Terms.
Changes to the Service or Terms
We may update the Service and these Terms from time to time. We will post the updated Terms on this page and update the “Last updated” date. If changes are material, we may provide additional notice through the Service.
Governing law
These Terms are governed by the laws of the jurisdiction where the Service provider is established, without regard to conflict-of-law principles. Where required, consumers may have additional statutory rights.
